Please note that the Act does not require an agency to create new documents to satisfy a request.<\/p>\n<p>As has been the case in your previous requests on this topic, information about specific employee leave is part of that employee\u2019s personnel record and not disclosable under \u00a7 4-311. Therefore, AACPS is denying your request for any data, including pay codes, related to these two circumstances.<\/p>\n<p>As you may be aware, \u00a74-206 (b) allows a custodian to \u201ccharge a reasonable fee for search for, preparation of, and reproduction of a public record.\u201d Under the provisions of the Act, the first two hours of labor would be provided free of charge. This should include the following fields for FY2019 for each employee broken down by paycode: Employee ID, Last Name, First Name, Middle Name, Title Code, Title Description, Unit #, Work Location, FTE, Total Salary, Pay Code, Pay Category (Pay Code Description), Pay Code Amount, Work Cycle, Grade, Step, Degree, Hire\/Seniority Date, and Years Experience. \u00a0The total salary field should be included in each record and the information broken down by pay code for each employee.<\/p>\n<p>In the past, when I have made this type of compensation request, you have arbitrarily excluded pay codes without either disclosing the excluded pay codes or justifying the claimed exemptions under Maryland\u2019s Public Information Act.\u00a0 I trust that this time you will both disclose and justify any excluded pay codes.\u00a0 If you refuse to disclose which pay codes you have excluded (which, of course, would also obviate the need for justifying particular pay code exclusions), please cite the Maryland Public Information Act provision that you claim allows you to do that.\u00a0 In past years, when you did provide all pay codes, there were a variety of other errors or omissions in what was provided, such as not identifying the FTE figure with the year of the compensation, that rendered the data unusable for analysis purposes. \u00a0I thank you for fixing those omissions (aka \u201cmistakes\u201d).<\/p>\n<p>I hope that if this time AACPS does provide all the pay codes, one of the previous omissions that rendered the data useless won\u2019t crop up again.<\/p>\n<p>Please charge me no more than the amount you have charged the <em>Capital<\/em> or individual AACPS Board of Education members for copying similar records. My estimate is that the per se downloading of the requested records from your multi-million dollar payroll system should take one of your payroll experts no more than a few seconds.\u00a0 Forwarding them to you as an email attachment should then take only a few more seconds.<\/p>\n<p>Please email me the requested data as an email attachment.<\/p>\n<p>If you deny any part of this request, please cite each specific Public Information Act exemption that justifies your denial of the information.
